Terms & Conditions

In these terms and conditions, “school” means ShireDrive Ltd, and “instructor” refers to the driving instructor who is providing your driving lessons.

Your instructor

Your instructor is authorized by the Driver & Vehicle Standards Agency to provide you with the required lessons.

You can expect your instructor to act in a courteous and professional manner at all times. He or she has been trained to a high standard and is regularly checked by the Driver & Vehicle Standards Agency.

Your instructor is a self employed franchisee of the school, and your contract is with your instructor. There is no contractual liability between you and the school, although the school will endeavour to assist you with your requirements.

Your instructor’s responsibilities

Your instructor will provide the use of a dual controlled car. It will be comprehensively insured and maintained to a high standard.

Should you request to use your own car for lessons, your instructor will advise you about the best course of action and will have the final decision if he or she feels it would be inappropriate to provide training in your car.

Your lesson will start and finish at your home or at a mutually agreed location within your instructor’s normal operating area.

You can expect your instructor to arrive punctually, but if for any reason he or she is late, your lesson will still last for the full period you have booked.

Your instructor will give you regular feedback about your progress and will advise you when to apply for your driving test or examination. The test is normally conducted in the same car in which you received your training. However this will be at your instructor’s discretion, and payment for driving lessons does not imply the right to use the instructor’s car for your driving test.

Your instructor undertakes to instruct in a proper and competent manner. However no warranty is given or implied that you will pass the Driver  & Vehicle Standards Agency driving test, or any other examination for which training is being given, within a specified number of lessons or at all.

Your instructor may decline to instruct you further, without being obliged to give any reason, but in the case of a prepayment, any unused portion will be refunded to you.

Your responsibilities

You must hold a valid driving licence, with at least provisional entitlement to drive in the UK in the category of vehicle in which training is being given.

You are responsible for paying your instructor for the training you receive as per the lesson prices published by the school. Prices may be changed at any time by the school, but the changes will only apply to future lessons which have not already been paid for as part of a prepaid block.

You will usually book your own driving test so that you can select a convenient date and time. Please quote your instructors ADI number. You are responsible for the payment of the test or examination fees to the Driver & Vehicle Standards Agency. Where your instructor’s car is used, payment to your instructor for the use of the car, and for his or her time, will be at the same rate as driving lessons in a school car.

It is important that you tell your instructor if you are not well or if you are taking any medication that may make you drowsy. Your instructor may refuse to provide training if, in his or her opinion, you are unfit to drive because of being affected by alcohol or any medication or drug, prescribed or otherwise, and he or she may charge for the period in question.

Payment

Payment is accepted in Pounds Sterling only.

Payment for single lessons should be made to your instructor before the end of the lesson to which it applies.

Payment for a block of lessons should be made by the start of the first lesson of the block, with cheques being made payable to “Shiredrive Ltd”. In the event that payment is made by a cheque that is subsequently rejected by your bank, any bank charge incurred by the school will be passed on to you.

Payment for a block of lessons may be made by credit or debit card using the secure website facility.

The following credit cards are accepted – MasterCard, Visa. Please note that payment with a credit card incurs a 2% additional administrative charge.

The following debit cards are accepted – UK Visa Electron, UK MasterCard Debit, UK Visa Debit, UK Maestro, Solo. There is no administrative fee for debit cards.

Refunds

Prepaid lessons must be taken within a period of twelve months from the date on which payment was made. Should you decide, within the twelve month period, that the unused portion of prepaid lessons are no longer required, a refund of the outstanding amount may be requested. It will be given to the person making the original payment by electronic bank transfer to their bank account. A valid receipt must be presented to obtain a refund.

This does not apply to Intensive courses – see the cancellation policy for intensive courses below.

Gift vouchers

Gift vouchers are available for 5, 10 or 20 hours though other number will be considered. The price is the same as that for other driving lesson payments, except that any current special offer prices are not available as gift vouchers.

Once payment has been received and confirmed, the voucher will normally be dispatched by  email, within 2 working days.

The voucher is valid for a period of twelve months from the date on which payment was made. Should you decide, within the twelve month period, that all or part of the voucher is no longer required, a refund of the outstanding amount can be requested. It will be given to the person making the original payment by electronic bank transfer to their bank account. A valid receipt must be presented to obtain a refund.

Cancellation

For normal lessons please give 48 hours notice for cancellation of a lesson. In the case where less than 48 hours notice is given, your instructor may charge for the period concerned.

Where your driving lesson or driving test is cancelled at short notice due to inclement weather or any circumstances outside your instructor’s reasonable control, neither the school nor your instructor will be held responsible for any financial liability you incur.

The policy for intensive courses is – 12 clear working days notice of cancellation must be given. The course fee is non-refundable where fewer than 12 working days notice is given.

Working days

ShireDrive Ltd. working days are Monday to Saturday inclusive, ie 6 days per week.

Complaints procedure

In the first instance please try to resolve any issues with your instructor.

The school will use its reasonable endeavours to respond to any outstanding issues and to resolve your concerns where possible. You will however, be asked to confirm the complaint in writing including any necessary documentary evidence where applicable.
